Delhi High Court Directs Former J&K CM Omar Abdullah to Provide ₹1.5 Lakh Monthly Support to Estranged Wife Payal Abdullah

A trial court had in April 2018 ordered Omar Abdullah to pay interim maintenance of ₹75,000 per month to Payal Abdullah and ₹25,000 to their son. The High Court enhanced the same on Thursday.

The Delhi High Court issued a ruling on Thursday demanding that former Chief Minister of Jammu and Kashmir, Omar Abdullah, provide a monthly maintenance payment of ₹1.5 lakh to his estranged wife, Payal Abdullah.

Justice Subramonium Prasad went on to instruct Abdullah to allocate ₹60,000 every month for the educational expenses of their son.

This verdict stemmed from a petition initiated by Payal Abdullah, who had approached the High Court in July 2018 to contest an April 26, 2018 order from the trial court.

Under the context of Section 125 of the Code of Criminal Procedure (CrPC), the trial court had initially granted temporary maintenance of ₹75,000 per month to Payal Abdullah, along with ₹25,000 for their son until he reaches the age of 18.

Seeking an increase in the amount, Payal Abdullah approached the High Court.

She contended that the granted maintenance was inadequate, emphasizing that their children were not yet of an age where they could independently cover their expenses, thus relying on their parents for their education and daily financial needs.

In a separate instance, back in 2016, a trial court had dismissed Omar Abdullah’s request for a divorce, citing his inability to substantiate claims of an “irretrievable breakdown of the marriage” or allegations of “cruelty or desertion”.

Subsequently, Abdullah has lodged an appeal against this ruling in the Delhi High Court.
