Kerala Court Grants Anticipatory Bail to Vlogger Mallu Traveller in POCSO Case

On the aforementioned Thursday, a court situated in Kerala, upon due consideration, accorded anticipatory bail to the individual identified as Shakir Subhan, colloquially recognized as Mallu Traveller. The legal proceedings pertained to a case registered under the aegis of the Protection of Children from Sexual Offences (POCSO) Act, initiated subsequent to a formal complaint lodged by the aforementioned individual’s former spouse.

The judicial dispensation, emanating from the purview of a Special Judge presiding over POCSO cases, sanctioned the anticipatory bail plea proffered by Subhan earlier in the same month, thereby affording legal reprieve to the aforementioned individual.

Shakir Subhan presently faces charges delineated under various sections of the Indian Penal Code (IPC), alongside allegations corresponding to penetrative sexual assault and aggravated penetrative sexual assault as encapsulated within the statutory framework of the POCSO Act.

As per the assertions advanced by the prosecution, the complainant, at the age of 15 in the year 2012, purportedly assented to matrimony with Subhan upon attaining legal majority. However, within a month subsequent to their contractual Nikkah ceremony transpiring on December 13, 2012, Subhan purportedly perpetrated multiple instances of penetrative sexual assault.

In a counter-narrative, Subhan contends that their marital union retained legal validity until the complainant secured a divorce in 2016. The contention further posits that he was misled regarding the veracious age of the complainant. Additionally, Subhan proffers that despite the legal dissolution of their marital ties in 2016, he conscientiously assumed responsibility for the offspring born of the union.

In disavowing any culpability, Subhan apprised the court of his status as the sole financial provider for his familial unit and expressed unequivocal willingness to adhere to any stipulations imposed by the court in conjunction with the pre-arrest bail.
