The Bombay High Court has cleared a man of rape charges, stating that the woman’s actions were not what one would expect from someone acting sensibly.
The Bombay High Court noted that the hotel room was close to the hotel’s bustling areas and remarked that the circumstances surrounding the alleged incident in the room “seem implausible”.
In a recent decision, Justice GA Sanap from the Bombay High Court Nagpur bench said, “The victim’s behavior does not match what would be expected from a prudent person in this situation.”
Regarding the woman’s claim that the man had booked a hotel room for their meeting, Justice Sanap said, “A girl meeting a young man for the first time wouldn’t go to a hotel room. This kind of behavior would clearly send warning signals to her.”
He also added that if a girl went with a stranger to a secluded place and got into trouble, she would probably call for help. “If a girl goes to a room with someone she doesn’t know and faces any danger, she’s likely to cry out for help,” he said.
Justice Sanap pointed out that the hotel room was close to the hotel’s busy areas and remarked that the circumstances of the alleged incident “seem unbelievable,” according to Lawbeat.
“In my opinion, the incident in the hotel room appears to be unbelievable. Additionally, the victim’s subsequent behavior does not align with what one would expect,” stated Justice Sanap’s order.
