Delhi High Court Acts on Sahodar Backed Plea for Rape FIR Database

New Delhi, August 6: In a development that could mark a critical step in addressing the growing concern of false allegations in sexual offence cases, the Delhi High Court on Wednesday directed the Delhi Police and other concerned authorities to expeditiously decide a plea—supported by Sahodar (NGO)—seeking the creation of a database of individuals who have filed multiple rape or sexual offence complaints.

The petition, filed by men’s rights activist Shonee Kapoor and legally backed by Sahodar, a national organisation working for gender-neutral laws and protection of men from legal misuse, requested that police district headquarters across Delhi maintain a record of repeat complainants. It also urged authorities to collect identity verification (preferably Aadhaar) from all individuals filing such complaints.

The Division Bench of Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela, while hearing the Public Interest Litigation (PIL), noted that the petitioner had already submitted a formal representation to the Delhi Police and other authorities. Without commenting on the merits of the plea, the Court disposed of the petition but directed the concerned authorities to take a reasoned and informed decision “with expedition.”

Importantly, when the petitioner requested a judicial direction for the creation of the database, the Court observed, “They (the authorities) know it better how the policing is to be done,” indicating that the implementation of such a policy falls within the executive domain.

Sahodar’s Involvement and Advocacy

Sahodar, which has been at the forefront of legal reform efforts aimed at curbing the misuse of matrimonial and sexual offence laws, has actively supported this petition as part of its broader campaign to protect innocent men from false allegations.

“We are not against genuine survivors—our fight is against legal misuse,” said a spokesperson for Sahodar. “The increasing number of false or repeated complaints in sexual offence cases not only jeopardises innocent lives but also erodes public faith in the justice system and undermines genuine victims.”

Sahodar has consistently received distress calls from men who have been accused of rape or sexual assault by complainants with a history of filing similar cases. The absence of any record or scrutiny of such repeated complaints often results in blind arrests, media trials, and prolonged litigation—causing irreversible damage to careers, families, and mental health.

What the Plea Seeks

The core demands of the plea include:

  • Creation of a district-wise database of complainants who have filed more than one rape/sexual offence complaint;
  • Mandatory ID verification at the time of lodging such complaints;
  • Administrative monitoring to detect patterns of misuse or frivolous complaints.

Sahodar believes that such a system would not only bring transparency and accountability but also help law enforcement differentiate between genuine and potentially malicious cases. “This is not about victim-blaming; it’s about truth-finding and judicial fairness,” the NGO emphasised.

A Call for Balanced Justice

While rape is a grave crime that must be punished with the full force of the law, the possibility of legal misuse must not be brushed aside. Sahodar has long argued that criminal jurisprudence must not ignore the rights of the accused, especially when evidence points to a pattern of vindictive litigation.

The NGO also pointed out that in cases where repeated complaints are filed by the same person, an independent review mechanism—possibly supervised by a judicial body—should be mandated before arrest or charge-sheeting.

  1. I appreciate the steps taken by Sahodar . Am also a victim of section 498A , DV and all package cases/sections. Managing to come out of these through mutual settlement ( of course loosing my hard earned house and money). But still okay with me as want to come out of it. Money gone , nothing is gone .
