Surviving for a woman is difficult in the judgemental society, but, for man is way too difficult. Men have to suffer more than women these days. They are facing discrimination from household to workplace too. Women harass men which tempts men to commit suicide.
According to section 498A of IPC, if wife files a report for against her husband or relatives of her husband for subjecting cruelty, they will be punished with imprisonment for a term which may extend to three years and shall also be liable to fine. Until July 2014, Indian Penal Code had allowed police to direct arrest the person whose name is mentioned in the complaint without any warrant or investigation.
Section 113B of the Indian Evidence Act, 1879, states that if a married woman committed suicide within 7 days of marriage, it is assumed by the court that her husband or his family abetted to suicide.
In India, the custody of child goes in favour of father only if mother’s mental state is unstable or left home behind the child. Under the Evidence Act, 1872, if a child is born within a marriage or within 280 days of dissolution of a marriage, then the child is considered legitimate and is entitled to child support and inheritance. At present, DNA paternity tests do not take precedence over this law. The courts may still choose to ignore the genetic evidence and ask a non-biological parent to pay for child support.
In 2010, a proposed amendment to the Hindu Marriage Act would allow courts to decide compensation to wife and children from the husband\’s inherited and inheritable property. The bill has provisions for \”irretrievable breakdown\” of marriage where both parties must have lived apart for three years before filing for divorce. The bill would also allow the wife to oppose the dissolution of a marriage if it would leave her in financial hardship.
As indicated by Section 497 of the Indian Penal Code, if the spouse submits infidelity with the wife of another man, he can be indicted for the equivalent. In any case, if a lady submits infidelity with the spouse of another lady, she can\’t be indicted.
Domestic violence against men has increased in recent years. But many cases are unreported because of men’s ego and embarrassment. Men reported being perpetrators of domestic violence with 22% reporting some form of physical domestic abuse, 17% sexual, 59% psychological, and 59.5% any form of domestic abuse. Men reported experiencing higher prevalence of all forms of violence, but reported experiencing lowest rates of sexual violence.
According to section 354D of IPC, Any man who—
- follows a woman and contacts, or attempts to contact such woman to foster personal interaction repeatedly despite a clear indication of disinterest by such woman; or
- monitors the use by a woman of the internet, email or any other form of electronic communication, commits the offence of stalking.
Punishment for the first conviction is imprisonment of either description for a term which may extend to three years, and shall also be liable to fine; and be punished on a second or subsequent conviction, with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine.
It is prohibited if men prove,
- it was pursued for the purpose of preventing or detecting crime and the man accused of stalking had been entrusted with the responsibility of prevention and detection of crime by the State; or
- it was pursued under any law or to comply with any condition or requirement imposed by any person under any law; or
- in the particular circumstances such conduct was reasonable and justified.
Men have begun sharing their desolation, torment, and provocation by ladies/companions. The time has come to perceive their concern as a social and general medical problem and create suitable techniques and mediations. They are not, at this point more grounded than ladies. They need assistance in emergency and family savagery: Particularly brutality by a companion is an emergency. Male casualties of viciousness can be spared/helped through proper mediation, for example, acknowledgment of savagery against men by ladies as a general medical problem; helpline for the male survivors of brutality; and instruction, mindfulness, and lawful shields.
