Madhya Pradesh High Court Refuses Bail to Woman Accused of Lodging False Rape Allegations Against Several Men

The Court observed that the woman has previously filed multiple rape cases against various individuals, including two against her husband.

The Madhya Pradesh High Court has recently rejected the bail plea of a woman who lodged five separate rape allegations against different men.

Seeking bail, the woman had petitioned the Court following accusations of extorting money from a man and vandalizing his shop.

Upon scrutinizing the case diary, Justice Maninder Bhatti noted direct accusations of extortion leveled against the defendant.

The Court remarked on the woman’s history of filing numerous cases against various individuals, including two against her husband.

“The statement of…(complainant) also reflects that upon being threatened he gave a sum of Rs.1,80,000/- to the present applicant. It is also not in dispute that the present applicant has also lodged 5 cases under Section 376 I.P.C against different persons including two cases against one…who, according to applicant, is her husband,” it said.

An FIR was lodged against the woman for various offenses including extortion, criminal intimidation, among others, under the Indian Penal Code (IPC).

Following her bail denial by the trial court, she appealed to the High Court.

During the proceedings, the woman’s counsel contended that since no assets or valuable items were transferred to her, the charge of extortion couldn’t be substantiated. Additionally, he argued that the trial court’s refusal of bail was influenced by previous cases of a similar nature against her, which should not have been the basis for denial, the Court was informed.

In contrast, both the State and the complainant asserted that the woman had a history of initiating false and baseless legal actions. They maintained that she had a pattern of coercion, resulting in multiple individuals being victimized by her actions, the Court heard.

After reviewing the arguments, the Court concluded it was not inclined to grant bail to the applicant.
