Supreme Court Expresses Distress Over Parents Using Child as a Pawn in Custody Dispute

“You both do not have any love for your child and are just fighting on the child’s expense,” the Court added on finding that the child had been sick since last November.

On Monday, the Supreme Court expressed concern for the well-being of a child caught in a custody dispute between their parents.

A Vacation Bench comprising Justices PV Sanjay Kumar and Augustine George Masih implored the battling parents to prioritize their child’s proper care, especially during the harsh summer in Delhi, rather than continuing their conflict.

The Court expressed distress upon discovering that the child has been ill since last November.

“You have not been able to find a good pediatrician till now. Both parents are making a pawn of their child. Absolutely terrible. You both do not have any love for your child and are just fighting on the child’s expense. So many months have passed,” Justice Kumar remarked, while addressing the parents.

“We are only concerned with rights of child and not any of you both. Take care of your child. It is extreme heat,” Justice Masih weighed in.

The Court emphasized the importance of safeguarding the child’s rights and interests. After listening to both parties, it ultimately granted the father visitation rights.
