Section 16 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) – Abetment of an Offence under POCSO Act, 2012
The Protection of Children from Sexual Offences Act, 2012 (POCSO Act) is a special legislation enacted to safeguard children from sexual offences. It provides comprehensive measures for prevention, protection, and punishment in cases of sexual assault, harassment, and exploitation of children.
Apart from direct commission of offences, the Act also recognizes that persons may play an indirect role in committing such crimes. This is where Section 16 becomes important, as it deals with abetment of an offence under the Act.
Meaning of Abetment under Section 16
Section 16 states that:
- Whoever abets any offence under this Act shall be punished with the punishment provided for that offence.
- In simple terms, if a person helps, encourages, conspires, or facilitates the commission of an offence under POCSO, they will face the same punishment as the main offender.
Abetment includes:
- Instigating another person to commit an offence.
- Engaging in a conspiracy to commit an offence.
- Intentionally aiding by act or illegal omission in the commission of an offence.
Punishment under Section 16
- The punishment for abetment of an offence is the same as the punishment prescribed for the offence abetted.
- For example:
- If someone abets penetrative sexual assault (punishable under Section 4), they will face the same punishment as the principal offender, i.e., imprisonment not less than 10 years (extendable to life) along with fine.
- Similarly, if abetment relates to use of a child for pornographic purposes, the abettor will face the same punishment as prescribed for that specific offence.
Conclusion
Section 16 of the POCSO Act ensures that not only direct offenders but also those who support, conspire, or encourage such heinous crimes against children are brought under the ambit of law. By equating the punishment of the abettor with the main offender, the Act sends a strong deterrent message that any form of involvement in child sexual offences, direct or indirect, will be dealt with sternly.
