Section 6 in The Special Marriage Act, 1954

Section 6 of the Special Marriage Act – Marriage Notice Book and Publication (Special Marriage Act, 1954)

Section 6 deals with the manner in which the Marriage Officer handles the notice submitted under Section 5. It ensures public transparency and gives validity to the marriage process.

Marriage Notice Book

  • The Marriage Officer must enter every notice of intended marriage received under Section 5 into an official register known as the Marriage Notice Book.
  • This book is a public document, and anyone can inspect it without any special permission.
  • Its purpose is to maintain an official record of all marriage notices, ensuring accountability and transparency.

Publication of the Notice

After entering the notice in the Marriage Notice Book, the Marriage Officer must:

  • Affix a copy of the notice in a prominent place in his office.
  • If either party is not permanently residing within the officer’s district, the Marriage Officer must send a copy of the notice to the Marriage Officer of the district where that party permanently resides.
  • The receiving Marriage Officer must also publish the notice in his office.

This system ensures that the notice becomes publicly accessible in all relevant districts.

Purpose of Publication

The publication process serves several crucial purposes:

  • To inform the public of the couple’s intention to marry.
  • To provide an opportunity for anyone to raise objections under Section 7.
  • To prevent marriages that may violate legal conditions such as age, existing marriage, or prohibited degrees of relationship.
