Succession when a Hindu Women Dies

The Clause which we are going to discuss in this article, applies only if a Hindu woman has a property and she has not prepared any Will. If she has prepared any will, the property distribution after her death will be preceded according to the will only.

If the Hindu Lady has not prepared any will before her death, then her properties will be distributed as follows:-

  • Her Property will be given to her Husband, her son & her daughter in equal share.
  • If the son or daughter has died, then their share of property will be handed over to their respective children.
  • If the Husband of the Lady has died, then his share of property will be given to Husband’s heirs whosoever they may be. If there are no heirs of Husband, property can be given to women’s Parents.
  • If the parents of Women are also no more, then the share of property will be given to Women’s Father’s heir and if they are also not there, then it will be given to mother’s heir.

Case where the Hindu Lady has also her Parents Property

  • In this Case, If a Hindu Lady has her Parents Property inherited from them on her name, after her death, such property will be divided equally among her Children. Her Husband would have no right on such property.
  • If the Lady’s Children are no more, then Children’s heir will get the share of property. If they also does not exist then, the Lady’s father’s heir will get the share of property.

Case Where the Hindu Lady has Property given after her Husband’s death or given by Father in Law

  • In this Case, if any Hindu Lady has got any property from her husband’s death or from her Father in law, that property will be divided among her children.
  • If her Children are no more, then the share of property will be given to Children’s heir.
  • If Children’ heir does not exist or are no more then, the share of property will be given to her Husband’s heir.

In a case, where two or more persons receive inheritance at the same time, then the money or property will be divided as per Capita & not as per strip. Both will get equal share.

If 2 persons die at the same time and there is a dispute regarding inheritance. Then the law is the younger one will be heir to the elder one.
